CALIFORNIA: “Parents cleared of false allegations remain on state's child abuser list”

In 2008, the United States Ninth Circuit Court of Appeals found that California’s Child Abuse and Neglect Reporting system is unconstitutional because it does not provide persons who were cleared of abuse allegations with a procedure to have their names removed. The court ruled that Los Angeles County should pay damages to the couple that challenged the law. On Monday, the U.S. Supreme Court decided to hear the case and decide whether Los Angeles County or the state of California should be required to pay the damages; the county claims that it should not be held liable for implementing a state law.
