In a de novo review, the Court of Appeals of Iowa reversed the juvenile court’s order terminating appellant father’s parental rights, finding that the state failed to show by clear and convincing evidence that the child could not be returned to appellant father’s custody within a reasonable time or that termination was not in the child’s best interest, based on its assessment that despite the father’s undisputed failure to comply with refrain totally from alcohol consumption, there was not clear and convincing evidence that the child could not be returned home, the father’s alcohol use had adversely affected the child or that he had a severe, chronic alcohol abuse problem.
