OKLAHOMA: Fent v. State ex re. Dep’t. of Human Servs. 01.28.2010 | Adoption
The Supreme Court of Oklahoma held as unconstitutional, under Article 2 § 6 of the Oklahoma Constitution, three Oklahoma statutes which require the courts to deposit portions of court filing fees to the credit of the Voluntary Registry and Confidential Intermediary program, the Mutual Consent Voluntary Registry for adoptees and the Child Abuse Multidisciplinary Account, finding that the fees were not used to fund the functioning or maintenance of the courts and, therefore, violated the public’s right to open access to the courts.
