MARYLAND: In re Adoption/Guardianship of Alonza D.

The Court of Appeals of Maryland reversed the circuit court ruling terminating appellant father’s parental rights, concluding that circuit court erred when it found exceptional circumstances justifying termination were present based on the length of time the children had been in foster care, but did not make a finding that it would be detrimental to the children’s best interest to continue a relationship with appellant father. Under Maryland law. in order to terminate a parent’s rights based upon the presence of exceptional circumstances, a court must make an explicit finding that a continued parental relationship would be detrimental to the child.
